Distance Sales Agreement.

BUYER. The user who registers on the ABA Tests Prep platform (mobile app or web) and purchases a paid service.

The subject of this agreement is to determine the rights and obligations of the parties, under Law No. 6502 on the Protection of Consumers and the Distance Contracts Regulation, in respect of the sale and delivery of the digital service — an ABA Tests Prep subscription, digital products and similar — whose characteristics and sale price are stated at the point of order and which the BUYER orders through the SELLER’s electronic platform.

Service. ABA Tests Prep subscription (monthly / annual / family plan).

Price. The amount displayed on screen at the moment of purchase and approved by the BUYER, inclusive of VAT and all taxes.

Payment method. Credit card, debit card, or in-store mobile payment systems (Apple App Store / Google Play Store).

The digital service that is the subject of this agreement is delivered immediately after the BUYER completes payment, by being activated electronically on the BUYER’s ABA Tests Prep account.

Unless cancelled by the BUYER before the end of the period, subscriptions renew automatically according to the period of the selected plan and are charged to the stored payment method.

Statutory position. Under Article 15(ğ) of the Distance Contracts Regulation, the right of withdrawal cannot be exercised in “contracts concerning services performed instantly in an electronic environment, or intangible goods delivered instantly to the consumer”.

ABA Tests Prep refund policy. Although the statutory exception applies because digital content is opened for use immediately, where the purchase was made directly on the website a refund may be reviewed by the ABA Tests Prep support team under defined conditions, counted from the date of purchase.

Mobile app purchases. Where the purchase was made through the Apple App Store or Google Play Store, ABA Tests Prep has no authority to issue a refund directly. Refund processes are governed entirely by Apple’s and Google’s own store agreements and refund policies.

For disputes that may arise from the performance of this agreement, the Consumer Arbitration Committees or Consumer Courts at the BUYER’s place of residence have jurisdiction, within the monetary limits announced by the Ministry of Trade.
