Distance Sales Agreement.
The contract for a programme bought remotely: the parties, the price, your right to withdraw, and where a dispute goes.

This Agreement is concluded under Turkish Consumer Protection Law No. 6502 and the Regulation on Distance Contracts, and governs any programme you (the “Buyer”) order electronically from ABA Group (the “Seller”) through abatestsprep.com. It also serves as the pre-contractual information required by Article 5 of that Regulation: read it before completing an order, because confirming the order means accepting it.
The parties
Seller. Registered title: ABA Group · Address: İstanbul, Türkiye · Email: hello@abatestsprep.com.
Buyer. The person named in the checkout form, at the delivery, contact and billing details given there. You are responsible for the accuracy of those details; we act on them, and an order we cannot confirm because a contact detail is wrong is not a failure of performance on our side.
Where the student is a minor, the parent or guardian named in the checkout form is a party to this Agreement alongside the student and is the person we contact.
Subject and scope
The subject of this Agreement is the sale of the preparation programme ordered electronically through the website, with the characteristics and price set out below, and the parties’ rights and obligations under Law No. 6502 and the Regulation on Distance Contracts.
It covers programmes bought directly from us. It does not cover subscriptions sold through the Apple App Store, which are billed, managed and refunded by Apple under its own terms, nor the free tier and the free level analysis, which carry no charge.
Our Terms & Conditions, Privacy Policy and Cancellation & Refund Policy form part of this Agreement. Where a term of this Agreement conflicts with them on a point of sale, this Agreement prevails.
The service and its price
Service. Premium Prep, a full-service preparation programme. It begins with a free level analysis sat under exam conditions, and continues with a study plan built on what that diagnostic finds, one-to-one coaching with a tutor, timed mock exams returned with feedback, and support with applications and score submission. The exam covered is the one you are sitting, from DSAT, UDSP, IELTS, TOEFL, PTE and YDS. Duration and session count are fixed with you at the diagnostic and confirmed in writing before the programme starts.
Price. The programme is listed at $5,000, inclusive of all applicable taxes. For buyers resident in Türkiye, the operative price is the Turkish lira amount shown in the order summary at checkout, calculated at the Central Bank of the Republic of Türkiye selling rate on the order date; that lira amount does not change afterwards because the rate moves.
The service is delivered online or in person and there is no physical shipment, so no delivery, shipping or handling charge is added. Any fee beyond the price shown in the order summary would have to be agreed with you in writing first.
Payment and invoicing
Payment is made by the method shown in the order summary, through our payment provider. No card details are collected on this website at any point, and no charge is taken from the checkout form itself — we confirm your details with you before any payment is requested.
The invoice is issued to the details you give at checkout. If a payment is declined, reversed or found to be unauthorised, we may suspend the programme until it is settled.
Performance: when the programme starts and how long it takes
We begin performance within 30 days of the order being confirmed at the latest, as the Regulation requires. In practice the first step is scheduling your free level analysis, and the programme calendar is set with you at that session.
If we cannot perform because the service becomes impossible, we will tell you in writing within three days of learning of it and refund everything collected within 14 days.
If a scheduled session cannot go ahead for a reason on our side, we reschedule it at no cost. Rescheduling on your side is covered by the Cancellation & Refund Policy.
Your right of withdrawal
You may withdraw from this Agreement within 14 days of the date it is concluded, without giving any reason and without paying any penalty.
To withdraw, send us a clear statement before the 14 days expire — email hello@abatestsprep.com, or write to the Seller’s address above. Any notice that reaches us within the period is valid; you do not have to use a particular form of words.
On a valid withdrawal we refund everything you have paid within 14 days, to the same payment method you used, and cancel any payment obligation you are under. We do not charge a fee for withdrawing.
When the right of withdrawal does not apply
Under Article 15 of the Regulation, the right of withdrawal does not apply to services performed instantly in electronic form or to intangible goods delivered instantly to the consumer, nor to services whose performance has begun, with your express consent, before the 14-day period expires.
This is why nothing is performed inside the withdrawal period unless you ask for it. If you do ask us to start early — for example to sit the diagnostic and begin coaching before the 14 days are up — we will record that consent, and you accept that your right of withdrawal lapses for the part performed.
Where the exception does not apply, or where the Cancellation & Refund Policy is more generous than the law requires, that Policy applies: a full refund within 14 days of purchase before services have substantially begun, a pro-rated refund thereafter, and no refund once the programme has been fully delivered, except where the law requires one.
Your undertakings
You confirm that you have read this Agreement and the pre-contractual information it contains before confirming the order, that the details you gave are correct, and that you are legally able to enter this Agreement.
If the student is under 18, the order must be placed or approved by a parent or guardian, and we may ask for confirmation of that before starting the programme.
Personal data
Personal data given for this order is processed to perform this Agreement, to invoice it and to meet our legal obligations, on the bases set out in our Privacy Policy and in accordance with the KVKK. It is not sold and is shared only with the providers who process the payment and support the Service.
Force majeure
Neither party is in breach for failing to perform because of an event beyond its reasonable control — natural disaster, epidemic, war, strike, or the failure of infrastructure or the internet. We will tell you as soon as we can, and we will reschedule the affected part of the programme. Where the event makes performance impossible for more than 30 days, either party may terminate and we refund the price of the part not delivered within 14 days.
Complaints and disputes
Talk to us first: email hello@abatestsprep.com and we will answer in writing. We aim to respond within 5 business days.
Buyers in Türkiye may take a dispute to the Consumer Arbitration Committee (Tüketici Hakem Heyeti) in the district or province of their residence or of the transaction, up to the monetary limits announced each year by the Ministry of Trade, and above those limits to the Consumer Courts (Tüketici Mahkemeleri).
This Agreement is governed by Turkish law. For buyers outside Türkiye, the mandatory consumer protections of your country of residence continue to apply, and where no consumer forum applies, the courts and enforcement offices of Istanbul have jurisdiction.
Conclusion, record and effect
This Agreement is concluded when you confirm the order on the website having accepted these terms. It is stored electronically by the Seller and made available to you on request.
The parties agree that the Seller’s electronic records — order, consent and correspondence records — are evidence under Article 193 of the Code of Civil Procedure. This does not restrict any right you have to produce evidence of your own.
